Water Gear Rental Agreement & Liability Release

1. Assumption of Risk

I understand that outdoor recreational activities including kayaking, canoeing, tubing, paddleboarding, and other water sports involve inherent risks including but not limited to:

Drowning or near-drowning incidents
Collision with natural and man-made objects
Weather-related hazards including cold water
Physical exhaustion and muscle injuries
Equipment malfunction or failure

2. Safety Requirements

I agree to comply with all safety requirements:

Wear a properly fitted Personal Flotation Device (PFD) at all times on the water
Never operate equipment under the influence of alcohol or drugs
Check weather and river conditions before use
Follow all instructions from 509 Outfitters staff
Report any accidents or equipment damage immediately

3. Equipment Care

I agree to treat all rental equipment with care and return it in the same condition as received. A $100 security deposit will be authorized 24 hours before delivery. You will not be charged unless gear is damaged beyond normal wear and tear.

4. Release of Liability

In exchange for being permitted to use 509 Outfitters equipment, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE 509 Outfitters, LLC, its owners, employees, and agents from any and all liability, claims, demands, actions, and causes of action arising from my use of rental equipment.

5. Medical Authorization

I authorize 509 Outfitters to obtain emergency medical treatment on my behalf if I am injured and unable to consent. I understand I am responsible for all medical costs.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I agree to be bound by its terms and understand this is a legal contract affecting my legal rights. I am 18 years of age or older and legally competent to enter this agreement.
